WE KNOW WE CAN COMPLETELY PAY FOR THEIR OUT OF POCKET COSTS.

THEY WILL GET THE REBATES TO PAY FOR APPROXIMATELY HALF OF IT,

RIGHT JOSH? >> YES.

AND THEN THE PARTNERSHIP WITH THAT GRANT MONEY CAN PAY FOR THE REST OF THOSE COSTS. THEY'RE ESSENTIALLY GETTING FREE LIGHTING UPGRADE WHICH HAS SO MUCH SAVINGS YEAR OVER YEAR AND IS THE BIG WIN THERE. WE TALKED TO THE WORTHINGTON MERCHANTS ABOUT THINGS THEY DO. WE HAVE A SIMPLE GRANT APPLICATION THAT JUST ASKS THEM WHAT THEY'RE DOING AND WE'LL HAVE THEM SHOW US THE INVOICES AND WE'LL REPAY THEM.

REALLY IT IS AN EASY PROCESS FOR THEM.

QUIKRETE IS A 50-YEAR RESIDENCE THERE AND ALSO HUNTLEY ROAD.

THE REASON FOR THE CHANGE IN THE ACCESS, ONE OF THE ACCESS TO THEIR PROPERTY IS TO ELIMINATE TRAFFIC SAFETY ISSUES REGARDING WAITING FOR THAT ABILITY TO ACCESS.

THIS SHOULD IMPROVE TRAFFIC FLOW.

THE CITY ENGINEER HAS ASKED TO REVIEW THE SPECIFIC PLANS.

THOSE PLANS MET WITH HIS APPROVAL.

THE CITY IS GIVING UP THE UPGRADING OF THAT ACCESS DRIVEWAY AND IT IS NOT A HEAVILY USED DRIVEWAY FOR CITY SERVICES, THAT WOULD BE A BENEFIT OF THE CITY FOR THE IMPROVEMENTS MADE TO THAT WILL COME AT THE EXPENSE OF QUIKRETE.

QUIKRETE WAS CONCERNED. THE EASEMENT IS FOR A 25-YEAR PERIOD. AND WE RESERVE THE CITY'S RIGHT TO TERMINATE THAT EASEMENT AGREEMENT IF THERE WERE A NEEDED TO SO FOR SOME OTHER PUBLIC OR QUASI PUBLIC PURPOSE.

IT IS NOT READILY ANTICIPATED BY STAFF THAT THAT WOULD HAPPEN.

IT IS THE ACCESS ROAD TO GET BACK TO THE HUNTLEY BOWL.

COUNCIL IS AWARE IT WILL BE HERE IN THE FUTURE TO BETTER SERVE SOME OF OUR STORM WATER RETENTION NEED.

LIKELIHOOD OF US NEEDING THIS FOR ANYTHING THAN IT IS CURRENTLY USED FOR IT REMOTE AT BEST.

HOWEVER, IN THE INTEREST OF LEGAL CAUTION I WANT TO RESERVE THAT. COUNTER PART TO THAT, IS THE AGREEMENT PROVIDES A SCHEDULE OF REPAYMENTS IF THE CITY WERE TO TERMINATE THAT AGREEMENT AND THEN THEY PAY FOR THE COST OF THOSE ROAD IMPROVEMENTS THAT THEY WOULD BE THE BENEFIT OF AT THAT POINT. THAT'S WHY THE LANGUAGE IS IN THERE. THIS IS A PROVISION IN THIS SINCE WE DON'T ROUTINELY GRANT THESE IT PRIVATE COMPANIES, THEY ALWAYS MAKE AN INITIAL PAYMENT TO THE CITY.

IT IS NONEXCLUSIVE EASEM MMENT WE DON'T GIVE UP THE RIGHT TO OTHERS. WE GIVE A PRICE TAG OF 5,000 DOLLARS. WHAT WE DID DO THOUGH BECAUSE WE VALUE IT, AND THE EMPLOYER WITHIN THE CITY IS CREATE ORT OF AN INCENTIVE FOR THEM TO STAY THROUGH AT LEAST A FIVE-YEAR PERIOD AND THEY STAY FINE MORE YEARS, WE WOULD REIMBURSE THAT 5,000 DOLLAR PAYMENT. THAT WAS NEGOTIATION AND QUIKRETE HAS AGREED TO THAT. OTHER THAN THAT, THE REST OF THE SORT OF TERMS OF THE AGREEMENT ARE STANDARD LANGUAGE, SIMILAR TO WHAT THE STATE OF OHIO USE WHEN IS IT GRANTS EASEMENTSO DIFFERENT ENTITIES. 25 YEARS IT -- MAKES IT LESS THAN PERMANENT EASEMENT. IN GRANT THEM AND THEN YOU'RE IN POSITION WHERE THE LAST LONG PAST THE NEED FOR IT.

IT IS CIRCLED IN RED AND COMES OFF MASON ALLEY.

IT RUNS NORTH AND SOUTH ALONG THERE.

A MANY RESIDENTS ALONG THE AREA HAVE THEIR ADDRESSES IN FRONT OFF OF HUTCHISON AND LYNNWORTH, HOWEVER, THEY ACCESS THEIR PROPERTIES AND PARKING AREAS AND SO FORTH OFF THE ALLEY.
