[B.1. Siding Replacement & Shed – 51 E. South St. (Sean Kocheran/Sweeney) AR 67-2020]

THE FIRST ITEM UNDER NEW BUSINESS AR67-2020 SIDING AND SHED REPLACEMENT AT 51E. SOUTH STREET.

PRESENTATION PLEASE P? >> 51 E SOUTH STREET.

THERE WAS A LOT OF VEGETATION HIDING THE HOUSE BUT IT'S BEEN CLEARED. YOU SEE IT'S A PRETTY SIMPLE CAPE COD STYLE HOUSE. AND THE FIRST THING THAT IS PROPOSED AS PART OF THIS IS TO CHANGE THE SIDING, CURRENTLY A VINYL SIDING AND THE NEW OWNER WOULD LIKE TO HAVE L.P. SMART SIDE USED, 7-INCH IT WILL BE REPAINTED A LIGHT GRAY.

AND THE TRIM WILL BE WHITE. THE SHUTTERS WERE NOT MENTIONED AS PART OF THIS, SO I DON'T KNOW IF THEY ARE PLANNING TO REPLAES -- REPLACE THE SHUTTERS AND IF SO WILL THEY STILL BE BLACK. WE NEED TO HEAR ABOUT THAT.

[00:05:04]

THE GRAGE HAS BOARD AND SIDING THEY WOULD LIKE TO CHANGE THAT TO THE SAME HORIZONTAL LAP SIDING THEY ARE USING ON THE REST OF THE HOUSE. THE OTHER PART OF THIS PROPOSAL INVOLVES REPLACEMENT OF A SHED IN THE BACK.

IT'S IN THE BACK CORNER. THE NEW SHED WOULD BE IN THE SAME SPOT AS THE OLD ONE. HERE IS THE SHED THAT'S THERE NOW AND HERE IS WHAT'S BEING PROPOSED.

IT SEEMS TO GO BETTER WITH THE HOUSE JUST WITH ITS ROOF FORM OTHER THAN THE ROOF OF THE OLD SHED.

I TOUGHT THEY HAD SAID IT WAS IN NOT GREAT CONDITION.

IT DOESN'T SEEM TO BE TOO HORRIBLE BUT A NEW SHED, I'M SURE, WOULD BE NICE FOR THE HOMEOWNER.

SO STAFF DOESN'T HAVE ANY CONCERNS WITH THIS APPLICATION.

>> YOU MIGHT BE ON MUTE MIKEL >> DO WE HAVE AN APPLICANT

THIS EVENING. >> DOES ANYBODY HAVE ANY QUESTIONS OR COMMENTS FOR STAFF? ALL RIGHT.

SINCE WE DON'T HAVE AN APPLICANT WE WILL TAKE A PAUSE FOR ANYONE WHO MIGHT BE LISTENING IN OR WATCHING IN ON THE WEBSITE. YOU CAN EMAIL US PLANNING@WORTHINGTON.ORG OR CALL THE NUMBER ON THE SCREEN IN A MOMENT. 1-567-249-0063.

AND ENTER THE CONFERENCE I.D.18374414 #.

>> THE APPLICANT HAS CALLED IN BUT HE WAS MUTED.

SO I JUST LET HIM KNOW T HIT *6 TO UMUTE HIMSELF.

IF THE BOARD HAS ANY QUESTIONS ONCE THE TIME IS UP.

>> ALL RIGHT. THANK YOU.

DIDN'T HAVE A CHANCE TO SPEAK BEFORE, DO YOU HAVE ANYTHING?

YOU NEED TO BE SWORN IN FIRST. >> I THINK H IS GOING TO TRY

TO CALL BACK IN MR. COULTER. >>

>> CHAIR COULTER:: OKAY. DID WE LOSE HIM?

>> HE WAS HAVING A HARD TIME GETTING *6 TO UNMUTE HIS PHONE.

>> CHAIR COULTER:: OKAY. >> THE ONLY QUESTION I HEARD IS

[00:10:04]

RELATED TO THE SHUTTERS. WE WILL SEE IF HE POPS IN.

I WOULD GIVE IT ONE MORE SECOND MR. COULTER.

I APOLOGIZE. >> CHAIR COULTER:: NOT A

PROBLEM. >> ACTUALLY I'M NOT SURE WHY I APOLOGIZED, IT'S NOT MY ISSUE.

LAUGH >> ARE YOU THERE? ARE YOU THERE, SEAN? SEAN?

>> I'M HERE. CAN YOU HEAR ME?

>> YEAH, I CAN HEAR YOU. >> WE CAN ALL HEAR YOU NOW.

>> I DON'T KNOW I WAS PRESSING *6.

>> THANK YOU, SEAN.

>> CHAIR COULTER:: DO YOU HAVE ANYTHING YOU WANT TO ADD TO

STAFF'S PRESENTATION? >> I DO, ON THE COLOR, THE HOMEOWNER IS DOING BENJAMIN MORRIS, SEA PEARL.

BASICALLY THE HOUSE WLL BE ALL WHITE AGAIN.

>> CHAIR COULTER:: THERE WAS A QUESTION RAISED ABOUT THE SHUTTERS. ARE THEY GOING TO BE REINSTALLED AND THE SAME COLOR AS WHAT THEY ARE NOW?

DO YOU KNOW? >> UNFORTUNATELY ON THE SHUTTERS, I DON'T KNOW. I DON'T KNOW THAT SHE HAS NECESSARILY PICKED A COLOR. WOULD THAT BE SOMETHING WE COULD COME BACK FOR THE SHUTTERS AT A LATER DATE?

>> I WOULD SUGGEST JUST THE BOARD DECIDE WHETHER YOU CAN IMPROVE IT WITH OR WITHOUT THE SHUTTERS AND WHATEVER SHE DECIDES WOULD BE OKAY. UNLESS YOU HAVE A PROBLEM WITH

ONE OR THE OTHER. >> NOT NECESSARILY.

I DON'T KNOW IF SHE WAS OVERLY FOND OF THE SHUTTERS.

I DON'T KNOW IF IT WAS A BIG STICKING POINT FOR HER EITHER.

>> CHAIR CULTER:: WHOEVER CRAFTS THE MOTION CAN MAKE IT SUCH TO HAVE THE SHUTTERS THEY WANT OR LEAVE THEM OFF SO YOU

DON'T HAVE TO COME BACK. >> THAT WOULD BE GREAT IF WE

CAN DO THAT. >> MS. PATAR, DID WE HAVE

ANYONE EMAIL OR CALL IN? >> NO, WE HAVE NOT.

>> CHAIR COULTER:: OKAY, BOARD MEMBERS ANY OTHER QUESTIONS OR COMMENTS? NOT HEARING ANY, CAN I HAVE A

MOTION, PLEASE? >> MR. CHAIRMAN, MR. FOUST MOVES THE REQUEST BY SEAN KOCHERAN, TO REPLACE THE SIDING AND ADD A SHED AT 51 EAST SOUTH STREET.

DRAWINGS AR67-2020 DATED SEPTEMBER 24TH, 2020 AND AMENDED TO ALLOW EITHER RETAINING OR REMOVING THE EXISTING SHUTTERS BE APPROVED BASED ON THE FINDINGS OF FACT, CONCLUSIONS AND STAFF MEMO AD PRESENTED AT THE MEETING.

>> MR. CHAIR, TOM REIS, I SECOND.

>> CHAIR COULTER:: THANK YOU. IT'S BEEN MOVED BY MR. FOUST, SECONDED BY MR. REIS. WOULD YOU PLEASE CALL THE ROLL.

>> MS. HOLCOMBE? >> YS.

>> MR. HOFMANN? >> YES.

>> MR. SCHUSTER? >> YES.

>> MS. HINZ? >> YES.

>> MR. REIS? >> YES.

>> MR. FOUST? >> YES.

>> AND MR. COULTER. >> CHAIR COULTER:: YES.

[B.2. Rear Step Relocation – 116 E Granville Rd. (Maxima Concrete, LLC/Miller) AR 68- 2020]

IT'S PASSED, THANK YOU. NEXT ON THE AGENDA I A REAR STEP LOCATION AT 116 EAST GRANVILLE ROAD.

APPLICATION AR68-2020. >> THE REAR PORCH TO THIS HOUSE HAS STEPS THAT COME DOWN TO THE SIDE YARD, AS YOU CAN SEE.

IT'S KIND OF A NARROW SPACE. SO THE HOMEOWNERS WOULD LIKE TO HAVE THE STEPS TO THE SIDE REMOVED TO REPLACE THEM ON THE

[00:15:04]

REAR OF THE HOUSE. THEY WOULD BE CONCRETE STEPS LIKE THE STEPS THAT ARE THERE NOW.

HAVE A RAILING, WOULD NOT HAVE THE TWISTED SPINDLES IN IT.

BUT OTHERWISE BE VERY SIMILAR TO WHAT'S THERE.

AS PART OF THIS CHANGE, THEY WILL RESTORE THE AREA WITH THE SAME TREATMENT, THE SAME RAILING THAT'S ON THE REST OF THE PORCH. AND THEY ARE GOING TO BE PUTTING NEW CONCRETE ALONG THE SIDE AND AROUND THE BACK.

THEY ARE PLANNING TO ADD A PATIO AROUND THE STEPS, AROUND THAT BACK PATIO, OR BACK PORCH AND THERE WILL BE A PATIO BY THE GARAGE TOO. TYPICALLY THAT TYPE OF INSTALLATION AT GRADE IS NOT APPROVED.

BUT I JUST WANT TO MENTION IT FOR YOUR INFORMATION.

AND ALSO SOMETHING THAT WOULD HAVE NOT HAVE NEEDED APPROVAL IS REPLACEMENT OF THE FRONT STEPS AND PORCH.

YOU CAN SEE THERE IS SOME DAMAGE THERE.

BUT THEY PLAN TO HAVE EVERYTHING LOOK JUST AS IT IS NOW. I THINK THE PERCEPTION IS THE RAILING WILL BE JUST LIKE THE ONE IN THE BACK.

SO STAFF HAD NO CONCERNS WITH ANY OF THIS WORK.

>> CHAIR COULTER:: THANK YOU. IS OUR APPLICANT WITH US THIS

EVENING? >> CHAIR COULTER:: WE AREN'T DOING REAL WELL ON OUR AUDIENCE TONIGHT.

>> YEAH, WE'RE NOT. >> CHAIR COULTER:: BOARD MEMBERS, ANY QUESTIONS FOR STAFF?

COMMENTS? >> I HAVE NONE, TOM RIES.

REIS. >> CHAIR COULTER:: THANK YOU, TOM. ALL RIGHT, NOT HEARING ANY QUESTIONS WE WILL GO AHEAD AND START THE CLOCK.

>> CHAIR COULTER:: MS. BITAR HAVE WE HAD ANYONE EMAIL OR CALL IN THIS EVENING ON THIS APPLICATION?

>> NO, WE HAVE NOT. THAT INCLUDES THE APPLICANT.

>> CHAIR COULTER:: OKAY. >> I WOULD SUGGEST, IF THERE ARE NO PROBLEMS WITH IT, THAT YOU GO AEAD WITH APPROVAL.

I'VE SPOKEN TO THIS APPLICANT A NUMBER OF TIMES AND HE WAS READY TO GO ON TIS A COUPLE WEEKS AGO AND WE DIDN'T GET IT ON THE LAST AGENDA. I'M NOT SURE WHY HE'S NOT HERE.

>> CHAIR COULTER:: ALL RIGHT, THANK YOU.

BOARD MEMBERS, ANY MORE COMMENT? NOT HEARING ANY.

[00:20:03]

>> MR. CHAIR, TOM REIS I MOVE THAT THE MOVE THE STEPS AT THE REAR OF THE HOUSE AT 116 EAST GRANVILLE ROAD.

AR 68-2020. DATED SEPTEMBER 24TH, 2020.

APPROVED BASED ON THE FINDING OF FACT AND CONCLUSION IN THE STAFF MEMO AND PRESENTED AT THE MEETING.

>> CHAIR COULTER:: CAN I GET A SECOND, PLEASE?

>> KATHY HOLCOMBE, SECOND. >> CHAIR COULTER:: THANK YOU.

IT'S BEEN MOVED BY MR. REIS, SECONDED BY MS. HOLCOMBE,

PLEASE CALL THE ROLL. >> MR. HOFMANN?

>> YES. >> MR. FOUST?

>> YES. >> MR. SCHUSTER

>>. YES.

>> MS. HINZ? >> YES.

>> MS. HOLCOMBE? >> YES.

>> AD MR. REIS? YES.

>> AND MR. COULTER. >> CHAIR COULTER:: YES, IT'S PASSED, THANK YOU. THAT COMPLETES OUR BUSINESS FOR

[C.1. a. Recreational Facility in I-1 – 640 Lakeview Plaza Blvd. (Columbus Fit Life LLC/Rhythm’s Musique Choreography LLC) CU 05-2020]

THE ARCHITECTURAL REVIEW BOARD. WE WILL MOVE ONTO MUNICIPAL PLANNING COMMISSION. THE FIRST I UNFINISHED BUSINESS. OF 640 LAKEVIEW PLAZA BOULEVARD.

I WILL FIRST NEED A MOTION TO TAKE IT OFF THE TABLE.

>> MR. FOUST MOVES TO TAKE IT OFF THE TABLE.

>> CHAIR COULTER:: SECOND, PLEASE?

>> TOM REIS, SECOND. >> CHAIR COULTER:: THANK YOU.

ALL THOSE IN FAVOR SAY AYE. OPPOSED SAME SIGN.

IT'S OFF THE TABLE, MS. BITAR OR MR. BROWN.

>> THE PLANNING COMMISSION ORIGINALLY HEARD THIS AT YOUR SEPTEMBER 10TH MEETING. THERE WAS A DISAGREEMENT BETWEEN HOW THIS BUSINESS SHOULD OPERATE BECAUSE OF NOISE CONCERNS WITH NEIGHBORING BUSINESS CENTERS.

AN AGREEMENT WAS REACHED AND IT WAS SUMMARIZED IN THE MEMO.

BUT THESE SEVEN POINTS ARE ALL PART OF THE AGREEMENT.

THEY AREN'T GOING TO HAVE ANY OUTDOOR CLASSES BETWEEN OCTOBER 15TH AND APRIL 1ST AND WILL NOT HAVE THAT OVERHEAD DOOR IN THE REAR OPEN DRING THAT TIME PERIOD, EITHER.

THE MAN DOOR CAN STAY OPEN, EVEN DURING THAT TIME PERIOD.

WHEN THEY DO HAVE CLASSES OUT IN THE PARKING LOT, THEY ARE GOING TO BLOCK OFF THE AREA WITH TRAFFIC CONES AND BARRELS TO WARN OTHER VEHICLES. LOUD SPEAKERS AND OTHER SOUND PROJECTION EQUIPMENT WILL NOT BE POINTED TOWARD THE PARKING LOT. THE MUSIC BEING PLAYED WILL BE MAINTAINED AT A MODERATE LEVEL SO AS NOT TO DISTURB THE OTHER BUSINESS ACTIVITIES. I ASSUME THAT MEANS IF ANOTHER BUSINESS COMES ORE AND SAYS THE MUSIC IS TOO LOUD THAT THEY WOULD LOWER IT. AT THAT TIME.

THESE USERS AND ANY FUTURE USERS OF THIS SPACE FOR EXERCISE CLASS. SO THAT, I THINK IS WHAT WAS ASKED OF THE PARTIES. I THINK STAFF IS COMFORTABLE.

WE FEEL THIS IS WHAT IS NEEDED TO BE ABLE TO APPROVE THIS.

>> CHAIR COULTER:: ALL RIGHT. THANK YOU.

COMMISSION MEMBERS, ANY QUESTIONS?

COMMENTS? >> THIS IS MR. FOUST, I WOULD JUST POINT OUT MY ONLY CONCERN BEFORE, IF WE ARE GOING TO DO ANY KIND OF A USE CHANGE IN AN AREA THAT DOESN'T HAVE A NEGATIVE IMPACT ON THE NEIGHBORS AND IT APPEARS THAT'S BEEN SATISFIED, SO I'M OKAY WITH IT NOW.

>> CHAIR COULTER:: OKAY, THANK YOU.

ANYONE ELSE? IS OUR APPLICANT WITH US

TONIGHT? >> YES, I'M HERE.

>> CHAIR COULTER:: ANNIE, SWEAR IN PLEASE.

>> OKAY. THIS IS ASHLEY --

>> DO YOU SWEAR THE TESTIMONY YOU ARE ABOUT TO PROVIDE IS THE

[00:25:03]

TRUTH, IF SO SAY I DO. >> I DO.

>> CHAIR COULTER:: ALL RIGHT, ASHLEY, YOU HAVE ANYTHING TO

ADD TO MS. BITAR'S SUMMARY? >> NO, THAT WAS IT.

AFTER THE LAST DISAGREEMENT THAT'S WHAT WE CAME UP WITH.

THAT'S THE ONE AND ONLY NEIGHBOR WE HAD A DISAGREEMENT WITH. SO I THINK THAT SUMS IT UP.

>> CHAIR COULTER:: THANK YOU. DO WE HAVE ANYONE ELSE WHO WANTS TO COMMENT OR ASK ANY QUESTIONS? ALL RIGHT. IF NOT, WE WILL START THE CLOCK.

>> MIKEL, YOU ARE MUTED.

>> CHAIR COULTER:: IT REALLY NEEDS TO BE AUTOMATIC.

WE HAVE A COUPLE WAYS YOU CAN CONTACT US.

CALL US AT THE NUMBER ON THE SCREEN.

OR EMAIL. ONCE YOU COME ON LINE HIT *6 TO

UNMUTE YOURSELF. >> CHAIR COULTER:: MS. BITAR, DO WE HAVE ANYONE ON THE PHONE OR WHO MAY HAVE EMAILED US THIS

EVENING? >> NO, WE DO NOT.

>> CHAIR COULTER:: OKAY. NOT HAVING ANYBODY EMAIL OR PHONE, COULD I HAVE A MOTION, IF THERE ARE NO OTHER QUESTIONS?

>> MR. CHAIRMAN, MR. FOUST MOVES THE REQUEST BY COLUMBUS FITLIFE L.L.C., RHYTHMS MUSIQUE CHOREOGRAPHY L.L.C. FOR A CONDITIONAL USE PERMIT TO OPERATE A RECREATIONAL FACILITY CASE C05-2020, DRAWINGS CU505-2020.

DATED SEPTEMBER 28TH, 2020 BE APPROVED BASED ON THE FINDINGS OF FACT AND CONCLUSIONS ON THE STAFF MEMO AND PRESENTED AT THE

MEETING. >> CHAIR COULTER:: CAN I GET A

SECOND? >> KATHY HOLCOMBE, SECOND.

>> CHAIR COULTER:: THANK YOU. MOVED BY MR. FOUST, SECONDED BY MS. HOLCOMBE, PLEASE CALL THE ROLL.

>> MR. HOFMANN? >> YES.

>> MR. REIS? >> YES.

>> MS. HOLCOMBE? >> YES.

>> MR. FOUST? >> YES.

>> AND MR. COULTER. >> CHAIR COULTER:: YES, IT'S PASSED. THANK YOU.

THAT CONCLUDES OUR BUSINESS UNDER THE MUNICIPAL PLANNING

[Additional Item]

COMMISSION. WE ARE GOING TO GO BACK TO THE ARCHITECTURAL REVIEW BOARD UNDER OLD BUSINESS.

AND WE ARE GOING TO REVIEW AN APPLICATION THAT WE REVIEWED AT OUR LAST MEETING. APPLICATION AR-64-2020.

BUT I WILL FIRST NEED A MOTION TO TAKE I OFF THE TABLE.

>> TOM REIS, SO MOVED. >> SCHUSTER, SECOND.

>> CHAIR COULTER:: OKAY, IT'S BEEN MOVED BY M. REIS AND SECONDED BY MR. SCHUSTER TO TAKE OFF THE TABLE.

ALL THOSE IN FAVOR, SAY AYE. >> AYE.

>> AYE. >> CHAIR COULTER:: OPPOSED, SAME SIGN. OKAY.

IT'S OFF THE TABLE. MAY WE HAVE OUR PRESENTATION,

PLEASE? >> THANK YOU, MR. COULTER.

AGAIN WANT TO APOLOGIZE TO THE BOARD, THERE WAS SOME CONFUSION WHETHER THIS WOULD BE ON THE AGENDA FOR THE NEXT AGENDA.

[00:30:05]

AR-64-2020, LOCATED 6723 NORTH HIGH STREET, THE GODDARD SCHOOL WE HAVE BEEN WORKING AT THE LAST YEAR AND A HALF.

AT THE LAST MEETING THERE WAS A DISCUSSION THAT RELATED AROUND THREE THINGS. IT WS THE TREES ALONG THE WESTERN PROPERTY LINE. AND EXPANDING THE FOOTPRINT OF THE PLAYGROUND TO THE WEST THAT CALLS THE NEED FOR THOSE TREES TO ALSO BE REMOVED. AND THEN ALSO THE DISCUSSION OF A FAUX VINYL FENCE ACROSS THE PROPERTY.

AT THE LAST MEETING THE BOARD TABLED THIS REQUEST TO GIVE THE APPLICANT TIME TO MEET WITH THE NEIGHBORING PROPERTY OWNERS.

I DID TALK TO TWO OF THE PROPERTY OWNERS, TWO IN QUESTION TO THE WEST. I SAW ONE JOINED IN ON THE MEETING. I BELIEVE THE OTHER ONE WLL TRY TO JOIN. THE BOARD GAVE DIRECTION TO TRY TO HAVE A DISCUSSION WITH THE NEIGHBORS.

AND THERE WAS A DISCUSSION ABOUT POSSIBLY REVISITING WHAT WOULD BE MODIFICATION TO THE LANDSCAPE PLAN AND SCREENING AND THE PLASTIC FENCE. WITH THAT, THE ONLY NEW NEWS I HAVE FOR YOU IS THE APPLICANT WOULD STILL LIKE TO EXPAND THE PLAYGROUND FOOTPRINT TO 15 FEET FROM THE WESTERN PROPERTY LINE.

AND ON THE SCREEN BEFORE YOU IS THE REVISED DIVIDE WOULD BE INSTALLED UP TO 6-8 FEET IN HEIGHT WAS SHOWN.

THAT WAS THE ONLY NEW INFORMATION W WERE PROVIDED.

THE EXISTING FOOTPRINT AND ALL THE MATERIALS YOU SAW BEFORE ARE STILL TO GO FORWARD. SO AGAIN, I THINK THE THREE DISCUSSION ITEMS WERE THE REMOVAL OF THOSE TREES, ALONG THE WESTERN PROPERTY LINE, EXPANSION AND THE PLASTIC FENCE.

>> ALL RIGHT. DO WE HAVE THE APPLICANT HERE?

>> YES, IF YOU CAN BOTH BE SWORN IN, PLEASE.

>> THE TESTIMONY

>> CHAIR COULTER:: ALL RIGHT, IS THERE ANYTHING YOU WOULD CARE TO ADD TO THE PRESENTATION TONIGHT?

>> THE ONLY THING IS THAT THE TREES SHOWN IN THE PHOTOGRAPH THAT, FIND SOMETHING THAT'S A LITTLE TALLER THAN THE 6-7 FEET.

WE ARE TRYING TO FIND SOMETHING THAT IS OVER 8-FEET TALL.

IF YOU, I DON'T KNOW IF YOU CAN PUT THAT POTOGRAPH BACK ON THE BOARD THERE. YOU CAN SEE THAT DOCUMENT THESE TREES ARE VERY FAST-GROWING. THEY GROW ABOUT THREE FEET PER YEAR IT SAYS 3-5 FEET BUT WE ARE HOPING FOR AT LEAST THREE FEET EACH YEAR TO PROVIDE A VERY THICK AND LUSH LANDSCAPE BUFFER BETWEEN THE SCHOOL AND THE NEIGHBORS TO THE REAR.

THERE IS A 15-FOOT DISTANCE BETWEEN WHAT IS THE EXISTING NEIGHBOR'S FENCE AND THE NEW PROPOSED FENCE.

SO THERE'S A FAIRLY WIDE AREA THIS WILL BE PLACED IN.

IT WILL BE STAGGERED IN PUTTING IN THE BACK OF THE PROPERTY.

SO IT'S NOT GOING TO ALL BE IN ONE LINE.

TO GIVE YOU A LITTLE BIT BETTER LOOK.

SO IT'S NOT SO REGIMENTED. SAML SAM ELLIOTT WHO IS WITH US THIS EVENING WNT AND TALKED TO BOTH THE NEIGHBORS.

SAYING IF YOU WANT TO DISCUSS YOUR DISCUSSIONS WITH THE NEIGHBORS, I'M SURE THAT WILL HELP.

>> SURE, I WANT TO THANK YOU ALL FOR ALLOWING US TO RETURN AND PRESENT A SOLUTION. WE HAVE SPENT AN ENORMOUS AMOUNT OF TIME OVER THE LAST COUPLE OF WEEKS.

WE HAVE WORKED DILIGENTLY WITH ARBORIST LNDSCAPE ARCHITECTS TO CEATE A VIABLE SOLUTION. NOBODY EVER WANTS TO TAKE DOWN TREES, LET ALONE 30-YEAR-OLD PLUS TREES.

BUT WE WERE TOLD REPEATEDLY THAT THE EXISTING TREES ARE UNHEALTHY AD THERE'S A SAFETY CONCERN.

SO WE HAD TO CREATE SOME FORM OF A SOLUTION.

WE WORKED WITH ALL OF THE PROFESSIONALS BUT I HAVE ALSO HAD MULTIPLE CALLS, EMAILS, FACE-TO-FACE MEETINGS WITH THE NEIGHBORS. WE TALKED ABOUT WHAT CAN WE DO

[00:35:01]

TO PROVIDE THEM THE SAME TYPE OF PRIVACY AND FRANKLY, I MEAN, BEAUTIFUL VISIBILITY THAT THEY ARE EXPERIENCING NOW.

I KNOW THAT, I THINK IT WAS MR. HOFMANN THAT WAS A LITTLE BIT CONCERNED ABOUT AT THE LAST MEETING.

WE WENT DOWN SO MANY DIFFERENT PATHS.

BOTH THE LANDSCAPE ARCHITECT AND LANDSCAPER SAID WHEN WE ARE TALKING ABOUT THAT TYPE OF HEIGHT AND DURABILITY, AND LIFE SPAN, THERE JUST REALLY WASN'T ANYTHING WE COULD PRODUCE BETTER THAN THAT. THAT'S WHERE WE CAME UP WITH THIS GREEN GIANT. AND THEY WERE HOPING, RANDY, MY PARTNER AND I WERE DOING EVERYTHING WE CAN TO FIND THE LARGEST ONES WE CAN. THAT'S WHY WE ARE TALKING ABOUT THE 8-9 FEET. WE TALKED ABOUT THAT WITH THE NEIGHBORS MR. JOSTE AND MR. KEMP.

WE HAVE BEEN OUT THERE AND LOOKED THROUGH IT.

WE HAVE ALL AGREED THOUGH IT'S NOT OPTIMAL THE EXISTING TREES HAVE TO COME DOWN, THIS IS UNEQUIVOCALLY THE BEST SOLUTION TO TRY TO PODUCE WHAT IS ALREADY THERE.

>> CHAIR COULTER:: ALL RIGHT. ANYBODY ELSE? BOARD MEMBERS? QUESTIONS, COMMENTS?

>> THIS IS MR. FOUST, JUST SO I'M CLEAR, THE TWO ADJACENT NEIGHBORS ARE BOTH HAPPY WITH THIS SOLUTION, CORRECT?

>> MR. JOSTE, I DON'T WANT TO SPEAK FOR YOU, BUT WE HAVE CERTAINLY GONE BACK AND FORTH AND WE CONFIRMED THIS IS THE BEST SOLUTION, THEY UNDERSTAND THAT.

>>

I'LL GO FIRST. >> DO YOU SWEAR THE TESTIMONY YOU ARE ABOUT TO PROVIDE IS THE TRUTH, BOTH CAN SAY I DO.

>> I DO. >> I DO.

>> THIS IS M. KEMP, I WILL AGREE WITH WHAT SAM JUST SAID.

WE HAD A LOT OF CONVERSATION. WE WALKED BACK THERE TOGETHER.

WE DON'T WANT THE TREES TO COME DOWN BUT BASED ON THE SITUATION AT HAND WE FEEL THE REPLACEMENT TREES ARE ACCEPTABLE, THEY SHOULD GROW QUICKLY AND AS LONG AS THOSE ARE HEALTHY AND GROW TALL WE ARE HAPPY WITH THE SOLUTION.

>> CHAIR COULTER:: MR. JOHNSON? >> THANK YOU.

I'M TOM JOHNSON, JOHN KEMP'S NEXT DOOR NEIGHBOR.

I AGREE WITH WHAT JOHN SAYS. I WANT TO THANK SAMANTHA ELLIOTT. SHE WAS REALLY PRETTY SPECTACULAR TO DEAL WITH THIS ON SUBSTITUTE.

LISTENED A LOT. SHE INDICATED DID A LOT TO TRY TO COME UP WITH IDEAS. SO I JUST WANT TO THANK HER FOR EVERYTHING SHE HAS DONE. I REALLY LOOK FORWARD TO HER

BEING MY NEIGHBOR. >> CHAIR COULTER:: ALL RIGHT.

THANK YOU. ANY OTHER QUESTIONS OR COMMENTS?

GO AHEAD. >> I WAS GOING TO SAY I THINK IT'S, I APPRECIATE THE REACH OUT AND THE COMPROMISE THAT SEEMS TO HAVE BEEN SETTLED ON. I THINK IDEALLY IT WOULD BE GREAT TO HAVE A LITTLE MORE VARIETY THERE BUT I THINK I CAN GET THERE WITH THESE, MAYBE PLANTED MORE STAGGERED AS IS THE RECOMMENDATION. I THINK I'M OKAY WITH IT, CERTAINLY BETTER THAN IT WAS BEFORE, SO WE APPRECIATE THAT.

>> CHAIR COULTER:: THANK YOU. I GUESS THE QUESTION THAT I HAVE, I AGREE ABOUT THE TREES. I'M FINE WITH MOVING THE FENCE BACK. WHAT I DO HAVE AN ISSUE WITH IS THE PLASTIC FENCE. THE QUESTION I WOULD HAVE IS WHY ARE YOU NOT PUTTING THE SAME TYPE THAT'S CURRENTLY THERE AND TAKING IT ALL THE WAY BACK.

YOU'VE GOT THE TREES TO BLOCK THE VISIBILITY.

I JUST DON'T UNDERSTAND WHY YOU WANT TO PUT A PLASTIC FENCE BACK THERE, IT SEEMS INCONGRUOUS WITH WHAT'S THERE NOW WITH HEIGHT -- WE WANTED SOMETHING --

[00:40:05]

CLOSER TO THE LANDSCAPE. >> YOU ARE MUTED MR. COULTER.

>> SAM, ARE YOU REPLACING THE ENTIRE FENCE WITH THE VINYL

FENCE OR THE REAR? >> NO, JUST THE REAR.

>> OKAY. >> CHAIR COULTER:: WHAT I WAS STARTING TO SAY, AND THANK YOU FOR REMINDING ME I WAS MUTED.

I DON'T BUY THE ARGUMENT OF THE PRIVACY BECAUSE YOU HAD THE PICKET STYLE FENCE EVEN THOUGH IT WAS 15 FEET IN.

I DON'T SEE ANY DIFFERENCE IN, AS FAR AS THE COMMENT THAT MR. BAKER MADE ABOUT KIDS REACHING UP AND GRABBING THE FENCE, 15 FEET BACK, IT'S 14 FEET BACK SO THAT THEY CAN'T DO THAT.

I'M FINE, I'M NOT FINE WITH THE VINYL FENCE.

BUT THAT'S JUST ME. EVERYTHING ELSE I'M GOOD WITH.

ANY OTHER QUESTIONS? >> I SHARE THE SAME FEELING ABOUT THE PLASTIC FENCE. I UNDERSTAND THE SAFETY.

IF THE PICKETS ARE GOOD FOR TWO THIRDS OF THE PROPERTY, I THINK IT'S ALSO GOOD FOR THE BACK OF THE PROPERTY.

GETTING THE LARGER TREES FOR SCREENING.

>> CHAIR COULTER:: ANYBODY ELSE? >> CAN I MAKE A COMMENT BACK ON

THE TREES AGAIN REAL QUICK? >> CHAIR COULTER:: YES, SIR.

>> TOM JOSTE. I HEARD THE COMMENT ABOUT STAGGERING THEM. IT'S MY UNDERSTANDING, MAYBE SAMANTHA AND THE ARCHITECT CAN CORRECT ME IF I'M WRONG.

IT'S MY UNDERSTANDING THAT PLEASE PARTICULAR TREES KIND OF GROW TOGETHER AND THEY FORM SORT OF A LINK ON THEIR OWN AS OPPOSED TO THE KIND BACK THERE NOW WHICH SHOULDN'T HAVE BEEN PLANTED SO CLOSE TOGETHER. THERE IS A DIFFERENCE AND I JUST HOPE THAT YOU KNOW, EVERYBODY KNOWS THAT, IF YOU PUT THESE THINGS IN WRITING OR NOT, WHAT THE BUILDERS ARE SUPPOSED TO DO WHEN THEY INSTALL THEM.

MY HOPE IS THEY DON'T SPREAD THEM TOO FAR OUT, OR THEY WON'T

GROW RIGHT. >> YOU ARE RIGHT, WE HAVE A LANDSCAPE ARCHITECT WHO WILL BE DRIVING THE LANDSCAPERS.

YOU ARE ABSOLUTELY CORRECT. THERE WILL BE A COMPLETE WALL WHERE THEY WILL BE BUILT. YOU ARE RIGHT.

STAGGER IS NOT A WORD I WOULD HAVE CHOSEN.

THEY WILL GO ACROSS. THEY CAN GROW VERY, VERY WIDE BUT THAT'S THE BENEFIT OF THIS CHOICE IS THEY WILL BE LIKE ONE BIG WALL. YOU SEE AT THE TOP WHERE THE TIPS ARE, IT WILL BE ALL ACROSS, ONE BIG WALL.

>> THANK YOU. >> ALL RIGHT.

NOW YOU ARE MUTED. >> I WOULD SAY WE WOULD FOLLOW THE GUIDANCE OF THE LANDSCAPE ARCHITECT.

WHATEVER HE COMES UP WITH IN TERMS OF A PLAN, WE WILL FOLLOW

WHAT HE IS PROVIDING US. >> WE ACTUALLY HAVE BETWEEN MY HOUSE AND NEIGHBOR'S HOUSE,

[00:45:01]

DRIVEWAY SIMILAR TYPE TREES. THEY HAVE BEEN GROWING VERY FAST AND THEY ACT AS A NATURAL FENCE.

I'VE SEEN AT OTHER PLACES. I LIKE THOSE.

IT'S A SOFTER TOUCH VERSUS SOMETHING THAT'S HARD.

I THINK IT WILL WORK OUT WELL. MY ISSUE IS JUST THE HARD FENCE ITSELF. THAT'S JUST ME.

ANYBODY ELSE HAVE ANY QUESTIONS OR COMMENTS THEY WANT TO MAKE? ALL RIGHT. IF NOT, I'M NOT HEARING ANY.

>> MIKEL, JUST ONE. IF WE COULD BIFURCATE THE VOTE, SO WE CAN VOTE SEPARATELY ON THE TREE VERSUS THE FENCE ISSUE.

>> CHAIR COULTER:: THEY ARE ONE IN THE SAME.

>> OKAY. >> I'M NOT SURE WE HAVE A

MOTION, DO WE? >> CHAIR COULTER:: NO.

WE NEED TO TAKE COMMENTS FROM THE PUBLIC.

>> THAT'S FAIR. I WILL START THE CLOCK.

THOSE WHO MAY BE WATCHING OR LISTENING OVER THE WEB IF YOU WANT TO COMMENT YOU CAN EMAIL US OR CALL US.

>> CHAIR COULTER:: MS. BITAR, HAVE WE HAD ANYONE CALL IN OR

EMAIL US THIS EVENING? >> NO, WE HAVE NOT.

>> CHAIR COULTER:: THANK YOU. BOARD MEMBERS, ANY OTHER QUESTIONS OR COMMENTS FOR THE APPLICANT? NOT HEARING ANY, CAN I HAVE A MOTION, PLEASE?

>> MR. CHAIR I MOVE THAT THE REQUEST BY SAMANTHA ELLIOTT FOR CERTIFICATE OF APPROPRIATENESS FOR MODIFICATIONS CONCERNING EXPANSION OF THE PLAYGROUND, TREE REPLACEMENT PLAN, 6733 NORTH HIGH STREET, DRAWINGS, 2064-2020, DATED SEPTEMBER 11TH, 2020 BE APPROVED BASED ON THE FACT THE FINDINGS OF FACTS OF CONCLUSIONS WITH THE AMENDMENTS THAT THE VEGETATION AND TREES THAT WERE PRESENTED TONIGHT BE PART OF THE DISCUSSION AND THE FENCE BE PER THE MATERIALITY OF THE EXISTING

FENCE, AS PREVIOUSLY PRESENTED. >> OKAY.

>> CHAIR COULTER:: JUST CLARIFICATION, MR. HOFMANN.

YOU SAID PREVIOUSLY PRESENTED. ARE YOU TALKING ABOUT AS

PRESENTED LAST WEEK? >> NO, I'M SORRY, THIS IS SAM ELLIOTT, CAN I ASK, ARE WE TALKING ABOUT GOING TO THE WOOD

FENCE OR PICKET FENCE? >> IT WOULD BE THE METAL PICKET FENCE ORIGINALLY APPROVED THAT WENT AROUND THE BUILDING.

>> OKAY, PERFECT. >> CHAIR COULTER:: DO I HAVE A

SECOND, PLEASE? >> SUSAN HINZ, SECOND.

>> CHAIR COULTER:: THANK YOU. IT'S BEEN MOVED BY COMMISSIONER HOFMANN, SECONDED BY COMMISSIONER HINZ, PLEASE CALL

[D. Other]

THE ROLL. >>

>> CHAIR COULTER:: YES, IT'S PASSED.

THANK YOU. GO AHEAD.

>> THAT'S ALL. >> CHAIR COULTER:: OKAY THANK YOU. THAT CONCLUDES OR BUSINESS UNDER THE ARCHITECTURAL REVIEW BOARD.

MR. BROWN AND MS. BITAR, IS THERE ANYTHING ELSE WE NEED TO

[00:50:03]

DISCUSS THIS EVENING? >> WELL THERE'S JUST TWO THINGS TO GIVE YOU A QUICK HEADS-UP ON. MANY OF YOU HAVE SEEN THE EMAILS FLYING THROUGH OVER THE PAST 24 HOURS RELATED TO THE U.M.C.H. APPLICATION THAT WAS DROPPED OFF ON MONDAY.

SO JUST TO LET YOU KNOW, WE JUST STARTED DELVING INTO THE TIME, BUT THEY ARE TENTATIVELY ON YOUR AGENDA FOR NOVEMBER 12TH. SO JUST TO GIVE YOU A HEADS-UP ON THAT. AND THE MALL REDEVELOPMENT WILL BE ON YOUR AGENDA FOR THE NEXT MEETING ON THE 22ND.

AND WILL PROBABLY ALSO BE ON YOUR MEETING AGENDA FOR THAT NOVEMBER 12TH. SO THE NOVEMBER 12TH MEETING, I WILL BE VIRTUALLY SENDING YOU COFFEE AND CAFFEINE VIRTUALLY.

HEADS-UP ON HOW THAT MEETING IS PROBABLY GOING TO BE A LONG MEETING. SO LYNDA AND I ARE BRAINSTORMING HOW TO HANDLE THE MEETING.

MAYBE SOMETHING SIMILAR TO WHAT WE DID WITH THE HOLIDAY IN AND STAFFORD VILLAGE, PUT A TIME LIMIT ON DISCUSSION TWO HOURS AND STOPPED IT AND WENT ONTO THE NEXT MEETING.

BECAUSE THE U.M.C.H. WILL BE A LENGTHY DISCUSSION, I FEEL.

OVERVIEW. I WANT TO GIVE YOU A HEADS UP OF THOSE TWO THINGS COMING AT YOU.

AT THE NEXT MEETING AND OUR NOVEMBER MEETING.

OTHERWISE I WILL ZIP IT. >> CHAIR COULTER:: OKAY.

BOTH OF THOSE PRESENTATIONS, THOSE ARE JUST FOR INFORMATION

ONLY, NOT FOR ANY VOTES? >> THE MEETING ON THE 12TH WILL BE THE THIRD OR FOURTH MEETING OF THE MALL REDEVELOPMENT.

THEY ARE PROBABLY GOING TO BE LOOKING MORE TOWARDS A VOTE FROM YOU AT THAT POINT. THE U.M.C.H. ONE, I DON'T FORESEE A REQUEST FOR A VOTE AT THAT ONE.

I DON'T THINK THAT WOULD EVEN BE POSSIBLE.

>> NO. >> CHAIR COULTER:: ALL RIGHT.

FOR THE MALL, ARE THEY GOING TO TRY TO DO JUST PHASE ONE OR

PHASE ONE AND TWO, BOTH? >> THEY WILL COME IN WITH THE P.U.D. SHOWING PHASE ONE AND PHASE TWO OF THAT.

THERE WILL PROBABLY BE MORE FLEXIBILITY BUILT INTO PHASE TWO TO ADDRESS COMMENTS AND CONCERNS WE HEARD FROM THE FIRST MEETING WITH BOARD COMMISSIONERS AND STAFF.

THIS WEEK I WAS ABLE TO PULL IN, OR DRAG IN MR. HOFMANN AND MS. HINZ TO SIT DOWN WITH US AND OUR CONSULTANTS AND THE TEAM OUT OF TEXAS TO TRY TO GO OVER COMMENTS ON SITE PLANS AND FLOW AND ARCHITECTURE. AND HOW THE SITE TALKS TO EACH OTHER, RELATED TO WHAT PORTIONS OF THE MALL WILL STAY.

THEY'VE GOT A LOT OF WORK TO DO. BUT THEY SEEM TO HAVE THE BANDWIDTH TO GET IT DONE. SO THERE'S DEFINITELY A LOT OF THINGS GOING ON RIGHT NOW. AND WE HAVEN'T HEARD ANY UPDATES AS OF TODAY, WHEN THE HOLIDAY INN MIGHT COME BACK IN FOR MR. SPENCER WHO PRESENTED TO YOU GUYS A MONTH AGO RELATED TO HIS PROPOSAL TO MODIFY WHERE THE HOTEL WAS SUPPOSED TO BE.

SO A LOT GOING ON. SO IT'S GOING TO BE A CRAZY FEW

MONTHS, AND OR INTO 2021. >> CHAIR COULTER:: ALL RIGHT.

THANK YOU. >> CAN I ASK A QUESTION?

>> CHAIR COULTER:: YES, SIR. >> QUICK QUESTION, WHAT IS THE STAFF AT HOLIDAY INN PROPERTY. I HEAR A LOT OF TALK IN OUR NEIGHBORHOOD WITH THAT, I WASN'T SURE WHERE IT ENDED UP.

>> IT GOT APPROVED OF FOUR BUILDINGS FR MX OF OFFICE AND RETAIL ALONG WEST WILSON BRIDGE ROAD.

ONE BUILDING AT THE CORNER OF HIGH AND KAREN AND ORIGINALLY APPROVED FOR A NEW HOTEL TO BE ON THE SITE ALSO.

WITH THE PANDEMIC, THE FUNDING FOR THE HOTEL, THAT BACKER BACKED OUT OF IT, SO THE HOTEL PORTION IS KIND OF DEAD IN THE WATER. SO THE PROPERTY OWNER IS LOOKING TO THE PORTION THAT WS TO BE THE HOTEL, THE PROPERTY OWNER IS WORKING WITH ONE OF THE DEVELOPERS IN THE REGION THAT DID THE CENTRAL HIGH UROLOGY BUILDING AT WEST 350 WILSON ROAD IS LOOKING AT THAT PORTION OF THE SITE TO DO KIND OF A MIXED UE BUILDING THAT WOULD HAVE RETAIL RESTAURANTS ON THE FIRST FLOOR. SECOND AND THIRD FLOOR OF OFFICE. AND THEN A FOURTH FLOOR TO BE A BOUTIQUE HOTEL, MAYBE 12-14 ROOMS.

[00:55:02]

AND THEN A PRIVATE CLUB ON THE UPPER LEVEL.

THAT'S AT LEAST WHERE IT STANDS RIGHT NOW.

BUT THE HOTEL PORTION OF IT, JUST WITH THE PANDEMIC, IF YOU WEREN'T ALREADY IN CONSTRUCTION THEY ARE ADDING THE HOTEL.
